Duties and powers of the Provincial People's Council (According to the provisions of Article 19 and Article 40 of the Law on Organization of Local Government)
1. Duties and powers of the Provincial People's Council in organizing and ensuring the implementation of the Constitution and laws:
a) Issue resolutions on issues within the tasks and powers of the Provincial People's Council;
b) Decide on measures to ensure social order and security, combat and prevent crimes and other violations of the law, prevent and combat bureaucracy and corruption within the scope of delegated authority; measures to protect the assets of agencies and organizations, protect the lives, freedom, honor, dignity, property, and other legitimate rights and interests of citizens in the province;
c) Decide on measures to perform tasks and powers delegated by higher-level state agencies; decide on decentralization to district-level and commune-level local authorities and lower-level state agencies to perform tasks and powers of local authorities in the province;
d) Abolish part or all of the illegal documents of the People's Committee and Chairman of the Provincial People's Committee; abolish part or all of the illegal documents of the District People's Council;
d) Dissolve the People's Council at the district level in case that People's Council causes serious damage to the interests of the People and submit it to the National Assembly Standing Committee for approval; approve the resolution of the People's Council at the district level on dissolving the People's Council at the commune level.
2. Duties and powers of the Provincial People's Council on government building:
a) Elect, dismiss, remove the Chairman of the People's Council, Vice Chairman of the People's Council, Head, Vice Head of the Provincial People's Council, Chief of Office of the Provincial People's Council; elect, dismiss, remove the Chairman of the People's Committee, Vice Chairman of the People's Committee and members of the Provincial People's Committee; elect, dismiss, remove the Jury of the Provincial People's Court;
b) Take a vote of confidence and vote of no confidence for the person holding the position elected by the Provincial People's Council according to the provisions of Articles 88 and 89 of this Law;
c) Dismiss the Provincial People's Council delegate and accept the request of the Provincial People's Council delegate to resign from his/her duties as delegate;
d) Decision to establish or abolish specialized agencies under the Provincial People's Committee;
d) Decide on the number of civil servants in the agencies of the People's Council, People's Committee, and public service units of the People's Committees at all levels in the province according to the staffing quota assigned by the Government; decide on the number and allowance levels for part-time workers at the commune, village, and residential group levels and approve the total number of employees in public service units under the management of the province according to the Government's regulations;
e) Decide to establish, dissolve, merge, divide villages and residential groups; name or rename villages, residential groups, roads, streets, squares, and public works in the locality according to the provisions of law.
3. Duties and powers of the Provincial People's Council in the fields of economy, natural resources and environment:
a) Decide on the province's long-term, medium-term and annual socio-economic development plans; planning and development plans for sectors and fields in the province within the scope of delegated authority;
b) Decide on the state budget revenue estimates in the area; local budget revenue and expenditure estimates and allocate the budget estimates at its level; adjust the local budget estimates when necessary; approve the local budget settlement. Decide on investment policies and project programs of the province in accordance with the provisions of law;
c) Decide on matters related to fees and charges as prescribed by law; contributions from the people; decide on borrowing domestic capital sources through the issuance of local bonds, urban bonds, construction bonds and other forms of capital mobilization as prescribed by law;
d) Decide on specific policies and measures to encourage and mobilize economic sectors to participate in providing public services in the province according to the provisions of law;
d) Decide on other measures to develop the socio-economy in the province according to the provisions of law;
e) Decide on construction planning and urban planning within the scope of decentralization as prescribed by law; regional economic linkages between local government levels in accordance with the local situation and characteristics and ensure the unity of the national economy;
g) Decide on the development planning of the system of industrial, agricultural, forestry, fishery extension organizations, trade, service, tourism, and transportation networks in the province according to the provisions of law;
h) Approve the province's land use planning and plans before submitting them to the Government for approval; decide on measures to manage and use land, water resources, mineral resources, marine and air resources, other natural resources, and environmental protection within the scope of delegated authority.
4. Duties and powers of the Provincial People's Council in the fields of education, training, science, technology, culture, information, physical education and sports:
a) Decide on measures to develop the network of educational institutions and conditions to ensure educational and training activities within the scope of decentralized authority; decide on prices of educational and training services for public educational and training institutions under the management of the province according to the provisions of law;
b) Decide on measures to encourage the development of scientific research, promote initiatives, technical improvements, and apply scientific and technological advances in the province;
c) Decide on measures to develop culture, information, physical education and sports; measures to protect and promote the value of local cultural heritage; measures to ensure cultural, information, advertising, press, publishing, physical education and sports activities in the province within the scope of delegated authority.
5. Duties and powers of the Provincial People's Council in the fields of health, labor and social policy implementation:
a) Decide on measures to develop the system of medical examination and treatment facilities at the provincial, district and commune levels;
b) Decide on prices for medical examination and treatment services for State medical examination and treatment facilities under local management according to the provisions of law;
c) Decide on measures to protect and care for people's health; protect and care for mothers, children, the elderly, the disabled, the poor, orphans with no one to rely on, and people in other difficult circumstances. Decide on measures to prevent and control epidemics; measures to implement population policies and family planning in the province;
d) Decide on measures to manage, use and develop local human resources; measures to create jobs, improve labor productivity, increase income and improve working conditions, ensure occupational safety and hygiene;
d) Decide on policies to attract and encourage cadres, civil servants, public employees, and workers working locally in accordance with local conditions, budget capacity, and regulations of superior state agencies;
e) Decide on measures to implement preferential policies for people with revolutionary contributions; measures to implement social security and social welfare policies, and measures to eradicate hunger and reduce poverty.
6. Duties and powers of the Provincial People's Council on ethnic and religious affairs:
a) Decide on measures to implement ethnic policies, improve material and spiritual life, raise the intellectual level of ethnic minorities, ensure equality among ethnic groups, strengthen national solidarity and mutual assistance among ethnic groups in the locality;
b) Decide on measures to implement religious policies within the scope of decentralized authority; measures to ensure equality among religions and freedom of belief and religion in the province.
7. Duties and powers of the Provincial People's Council in the fields of national defense, security, ensuring social order and safety:
a) Decide on measures to ensure the implementation of national defense and security tasks according to the provisions of law; maintain political security, fight against corruption, crime, and other violations of the law, and ensure social order and safety in the province;
b) Decide on policies and measures to promote local potential to build a strong national defense and people's security, build a solid defense zone to meet the requirements of peacetime and wartime;
c) Decide on policies and measures to build local militia, reserve mobilization, and communal police forces; decide on policies and measures to combine economy with national defense and security, and transfer local socio-economic activities from peacetime to wartime;
d) Decide on measures to ensure public order and traffic safety in the province.
8. Supervise compliance with the Constitution and laws in the locality, the implementation of resolutions of the Provincial People's Council; supervise the activities of the Standing Committee of the People's Council, the People's Committee, the People's Court, the People's Procuracy at the same level, and the Committees of the People's Council at the same level; supervise legal documents of the People's Committee at the same level and documents of the District People's Council.
9. Perform other duties and powers as prescribed by law.
